CONDITIONS OF USE
By using this website, you certify that you have read and reviewed this agreement and that you agree to comply with its terms. If you do not want to be bound by the terms of this agreement, you are advised to leave this website accordingly. CMP only grants use and access of this website, its products, and its services to those who have accepted these terms.
You agree that all materials, products and services provided on this website, as well as the end product of the services we provide, are the property of CMP, its affiliates, directors, officers, employees, agents and/or licensees, including, but not limited to, copyrights, trade secrets, trademarks, patents, and other intellectual property. You also agree that you will not reproduce or redistribute CMP's intellectual property in any way, including electronic, digital or new trademark registrations. EXCEPTION - CMP grants the right to any purchaser of services, including Basic MLS Measures, Floor Plans, BOMA Measures and Deed Plots, to share these work products as the user deems necessary, including, but not limited to your MLS system as digital supplements, the North Carolina Real Estate Commission, your clients, agents or assigns. To comply with this exception, the user may not remove or alter CMP branding or attributes.
By visiting this website, you agree that the laws of North Carolina, without regard to principles of conflict laws, will govern these terms and conditions, or any dispute of any sort that might come between CMP and you, or its business partners and associates.
Any dispute related in any way to your visit to this website or to services and products you purchase from us shall be arbitrated pursuant to the rules of the American Arbitration Association. For disputes related to Basic MLS Measures that ultimately involve the North Carolina Real Estate Commission, CMP services are provided by licensed NC Brokers and we hold ourselves, our actions and our service products, responsible to the Commission, its rules and its regulations, for all measures we perform on behalf of other NC Licensed real estate professionals. As such, the Commission has a long standing history of holding service providers, such as CMP, responsible to the accurate services we promise to provide while adhering to Commission rules.
Users that are provided CMP services ordered through this site agree that if payment for said services is more than 30 days in arrears, CMP may place a lien, or file a lis pendens upon the subject property and that a $100 lien service fee will be added to user's balance. CMP may also opt to file a small claims action in order to collect any unpaid balance, upon which a $100 fee will be applied. On properties where the services provided are for the sale of the property and said property is listed with a licensed real estate firm, a listing agent ordering any services agree that the property listing is, in fact, owned by their firm and, as such, we may hold that firm liable for any unpaid fees. Further, real estate brokers ordering services for a property. with said brokers acting as agents for the sellers of a subject property, agree that we may seek payment from such sellers for any unpaid balances.
You agree to indemnify CMP and its affiliates and hold CMP harmless against any legal claims and demands that may arise from your use or misuse of our services.
LIMITATION ON LIABILITY
CMP is not liable for any damages that may occur to you as a result of your misuse of our website. CMP's liability for any user claim arising from an inaccurate measure or floor plan is the cost the user paid for the service.
